Welcome to Stamper’s Boat Barn, Inc. (the “Site”). These Terms govern your access to and use of stampersboatbarn.com and the purchase of any products, including new and used outboard motors, MerCruiser engines and parts, used boats, and marine accessories (the “Products”). By using the Site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site or purchase Products.

1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site or place an order.

2. Product Descriptions and Pricing
We make every effort to display accurate descriptions, images, condition reports, and pricing — especially for used motors, engines, and boats. We don’t warrant that all content is complete or error-free. Prices are in USD, exclude taxes/shipping/duties, and are subject to change. We may correct pricing errors and cancel orders placed at incorrect prices, even after confirmation.

3. Orders and Payment
Placing an order is an offer to purchase, which we may accept or decline. Payment is due in full at checkout via our accepted payment methods, processed securely by third-party processors. Title and risk of loss transfer to you upon delivery to the carrier. We may limit quantities, cancel orders, or refuse service, including for suspected fraud.

4. Shipping and Delivery
Governed by our Shipping Policy. Delivery times are estimates only; we’re not liable for carrier delays, weather, or other factors outside our control.

5. Returns, Refunds, and Warranties
Governed by our Return & Refund Policy and Warranty Policy, including our 90-day return window and tiered warranty coverage by product type. Except as expressly stated in those policies, products are sold “as-is” with no additional warranties.

6. Limitation of Liability
To the fullest extent permitted by law: the Site and Products are provided “as-is,” without warranties of merchantability, fitness for a particular purpose, or non-infringement, beyond what’s expressly stated in our Warranty Policy. We’re not liable for indirect, incidental, or consequential damages arising from use of the Site or Products. Our total liability for any claim is limited to the amount paid for the product giving rise to the claim. Some jurisdictions don’t allow these exclusions, so they may not apply to you.

7. Intellectual Property
All Site content (text, images, logos, product photos) is owned by us or our licensors and protected by copyright and trademark law. You may not reproduce or distribute it without written permission.

8. User Conduct
You agree not to use the Site unlawfully, interfere with its operation or security, submit false information, or attempt to access restricted areas.

9. Privacy
Your information is handled per our Privacy Policy.

10. Indemnification
You agree to hold Stamper’s Boat Barn, Inc. harmless from claims arising from your violation of these Terms or misuse of the Site or Products.

11. Governing Law
These Terms are governed by the laws of the State of Ohio. Disputes are resolved exclusively in state or federal courts located in Montgomery County, Ohio, and you consent to jurisdiction there.

12. Force Majeure
We’re not liable for delays caused by events beyond our reasonable control (natural disasters, strikes, supply chain disruptions, etc.).

13. Changes to These Terms
We may update these Terms at any time; changes are posted here with a new effective date.
